These Terms and Conditions are intended to define the rules applicable in connection with the sale of branded products Madura (registered trademark) on the Website,



A joint stock company with a capital of 400 000 Euros, whose registered office is at 11 rue de Poissy, 75005 Paris, registered with the RCS Paris under the number 522 420 025.


Any person of legal age, non-retailer, having the legal capacity to contract (hereafter, the “Customer”) purchasing a product on the Website www.madura.fr .

For the purposes hereof, it is agreed that the Customer and the MADURA ONLINE company will be collectively referred to as the “Parties” and individually referred to as the “Party”.

These general conditions (hereafter the “Terms and Conditions”) govern unrestricted sales of Products made by MADURA ONLINE company from the Website.

The MADURA ONLINE company reserves the right to modify at any time these Terms and Conditions by publishing a new version on the Website. The Terms and Conditions applied are those in effect on the Website at the time of placing the order by the Customer; provided that any order for a product offered on the Website constitutes full acceptance of the Terms and Conditions in effect at the time of placing the order.


These Terms and Conditions are intended to define the conditions under which Products are marketed by the MADURA ONLINE company, to the Customer. Thus, they regulate the various stages of completion of the sale: the transfer of the order by the Customer to the delivery of the Product to the Customer.


Products offered for sale by the MADURA ONLINE company are those listed on the Website the day of their consultation by the Customer; it being understood that the photographs illustrating the products are not contractual. Each product will be a description, which, in addition to photography, includes: price, photography, availability of sizes and colors, compositions and special features. Small differences may exist between the product and its photography, depending on the screen resolution and the definition of colors of the screen of the computer of the user.

The MADURA ONLINE company is committed to delivering products that meet the requirements concerning the safety and health in accordance with European legislation, including legislation on regulated chemicals.


Prices are in Euros including all taxes, excluding shipping costs, it being understood that the value added tax is in effect in the metropolitan French territory on the day of confirmation of the order.

The prices are those given on the Website and confirmed to the Customer during the order validation.

We reserve the right to modify our prices at any moment but will apply the current rates as indicated to you on the site at the time the order was placed.

We would like to inform you that if an obviously incorrect price appears on our website (a price that is clearly too low, for example), and for whatever reason (IT bug, human error, technical error etc.), your order will be cancelled, even if it has been initially validated.

Shipping fees are disclosed to the Customer on the order summary before confirming them and are expressed inclusive of all taxes. These costs are at the expense of the Customer and are charged in addition to the sales price of the Products.

The transfer of risks of loss and deterioration of products will be made after delivery and receipt of the Products by the Customer.


4.1 Ordering Products

The Customer creates an order by completing the following 5 steps

Step 1 : The Customer selects the chosen Product and adds it to his cart after selecting the size and color.

The basket at the top right of your screen informs you that your addition has been added by indicating the number of items it contains.

Step 2 : The Customer checks the contents of the basket by clicking on “order” to gain access to the summary of the order. The Customer can then modify his order (Product, Size, Quantity).
The total tax of the order, distinguishing from price payable in respect of Products and other delivery charges, is then indicated in the summary.

Step 3 : Once the order is checked and amended if necessary, the Customer confirms their cart to finalize the order by clicking again on order.
If the Customer has an advantage code, only the very best Customers have one, he will include it in the space provided for this purpose in order to benefit from it.

Step 4 : Entering delivery and billing details by the Customer
Fields marked with an asterisk (*) are required fields; being understood that unless otherwise specified by the Customer, the billing address will automatically be the same as the shipping address.
If a Customer has already placed an order on the Website, they will have a customer account. In such a case, he will be able to identify himself with only his email address and password.
The Customer can then verify all information and clicks on “Submit” to continue his order.

Step 5 : Banking Information

The Customer will access on the screen the secure payment as specified in section 4.3 below.

Payment is made online by credit card only.
The Customer must enter their credit card number, the expiration date and the 3 CVV numbers on the back of this card; it being understood that in case of payment by American Express, the Customer must provide 4 digits.
If payment is accepted, the Customer is redirected to a confirmation screen control on the Website.

In the event of failing settlement, the Customer will have up to three attempts to re-enter their bank details. After the third refusal, the Customer is re-directed on the Website to a screen informing him refusal of payment. The Customer is requested to contact the customer service to know the reasons and find a solution to complete the customer order.

4.2 - Confirmation of the Order

Upon acceptance of payment by the Customer; the Customer will receive an email confirming his order and summing all items ordered, billing address and delivery and the date of delivery.

The validation of the order by the Customer and the confirmation of the order sent to the Customer by email following the acceptance of payment brings a contract of sale between Parties and acceptance of Terms and Conditions.

The Customer having placed an order will have the option to print the invoice by logging onto the Website in the space provided for this purpose.

The MADURA ONLINE company reserves the right not to accept the order in the case of:

  • Abnormal or abusive claims
  • Abnormal orders with regard to the quantity ordered
  • Abnormal or abusive returns and exchanges
  • Existing disputes with the Customer

Customer Service’s Website is available to the Customer for all matters relating to his order. Customer Service is available by email (eshop@madura.fr) and by phone at +(33)1 80 05 15 41 , Monday through Thursday, 10 am to 1 pm and 2 to 6 pm, and until 5.30 pm on Friday. 

4.3 - Payment

The price of products purchased is payable in cash in full on the day of placing the order by the Customer.

LPayment is made online by credit card (Visa, Eurocard/Mastercard/American Express) when validating the order by the Customer.

The request for authorization for debiting the card is made at the time of confirmation of the order on the Website, exception made for unavailability of servers. The MADURA ONLINE company reserves the right to reapply for permission to deduct if the first try could not succeed due to unavailable servers.

In the even of a default of payment to the wrong address or any other problem on the Customer’s account, the MADURA ONLINE  company reserves the right to block the Customer’s order pending the resolution of the problem.

In case of fraudulent use of their credit card on the Website, the Customer should contact the MADURA ONLINE company at the following number: +(33)1 42 34 99 59, Monday through Thursday, 10 am to 1 pm and 2 to 6 pm, and until 5.30 pm on Friday, or by email at the following address:eshop@madura.fr.

Transactions on the Website are secured by the payment system partner of the MADURA ONLINE company, the company ADYEN B.V. a company registered in the Netherlands under company number 34259528 whose registered office is at Simon Carmiggeltstraat 6-50, 1011 DJ, Amsterdam, the Netherlands.

All information exchanged to process the payment is encrypted using SSL (Secure Socket Layer). This data cannot be detected, intercepted or used by others. At no time will the financial data for the Customer pass through the computer system.

Ogone verifies that the connection to the client browser is secure before sending the payment form to the bank making the financial transaction.

Ogone being a service provider, does not deal with disputes arising from orders which are processed directly by the MADURA ONLINE company as mentioned before or if necessary the Customer’s bank.

4.4 - Orders Archives

The order confirmation is recorded in the books of the MADURA ONLINE company, stored in a reliable and sustainable area. The Customer agrees that confirmation of the order is seen as evidence of the contractual evidence between the Parties.


The MADURA ONLINE company will deliver orders with a delivery within a maximum of ten (10) business days for delivery to Metropolitan FRANCE and twenty (20) business days for delivery for any other destination counting from the day following receipt of the order.

Any order registered on the Website Monday through Thursday before 11:00 am can be processed the same day. The period can't be applied during sales or strong commercial activity (Black Fridey etc.). All orders placed from 3:00 p.m. Friday to Sunday evening will be processed the following Monday; it being understood that orders placed on a holiday will be processed the following business day.

Exceeding the delivery time, not justified by force majeure (Act of God), the Customer may request cancellation of the sale and obtain within a maximum period of 30 (thirty) days the refund of the amount paid in connection with the sale.

For international orders, your country may apply customs duty on this import, and you will have to pay the duty in order to get the goods.


The Customer is required to verify the correctness of products received under his order at the time of delivery.

Any anomaly concerning the delivery such as:

  • Damaged packaging
  • Missing products
  • Damaged products
  • Products not complying with the order, must be addressed within legal delay after receipt of order.
  • The Customer must attach to his package the completed return form beforehand printed using the feedback form available from the customer area- Category “My Orders”. No returns will be accepted without the aforementioned return form completed.
  • Products must be returned in their original packaging, or in any package protecting the product from damage, with labels and any accessories, in perfect condition to be sold again on the website to this address : MADURA – 1 à 3 rue Ambroise Croizat – ZA Pariest – 77183 Croissy Beaubourg –France.
  • The risks and costs of returns are the sole responsibility of the Customer.

Where defects have been confirmed, the MADURA ONLINE company proposes to the Customer Reimbursement of the order price (price of products and delivery charges) and cost of shipping, no later than within thirty (30) days from the mailing date of notification confirmation of error by the customer service Website Madura.

In case of a reimbursement, the MADURA ONLINE company will fully refund the cost of goods less any import duties or taxes.

When receiving a damaged product, the return fees will be refunded according to the prices of Colissimo International or National Post of your country (international express shipping as UPS will not been refunded). The Client has to send a proof of the return fees by email to Customer Client, by email to eshop@madura.fr.

In case of abnormal or abusive claims, the MADURA ONLINE company may refuse to serve later orders.


The Customer has fifteen (15) days from the date of receipt of his order to return the Products ordered, without justification or penalty.

For any return, the following procedure must be fully respected:

    • If the order has been delivered in-store or at home by the post office (Colissimo or Chronopost) the return is made by post to our logistics center of Croissy Beaubourg (address indicated below). As provided by the Consumer Code, in case of withdrawal the return costs are charged to the customer.
    • Madura/Entrepôt Logistique 1 à 3 rue Ambroise Croizat ZA PARIEST 77183 Croissy Beaubourg France
    • If the order was delivered by Relais Colis, the return is free. The customer must request a return label to Madura.fr. Then, he has 3 weeks to drop off his parcel at the point of delivery of his choice. Outside this period, the carrier Relais Colis authorizes itself to refuse free support for the return.

For any purchase made over the Internet, no return will be made in Madura shops.

Shipping costs are refunded if the entire order is returned.

The items must be returned in their original packaging, with their label and any accessories, in a perfect state of resale. They must therefore not have been worn, washed or damaged.

The customer must attach the return voucher to his parcel to be completed and print it in his Customer Area / My orders.

The refund is made within a maximum of thirty (30) working days after receipt of the return by bank credit or recreation of the Paypal account.

If these conditions are not met, www.madura.fr reserves the right not to accept your return.

These conditions are only valid for people who have purchased on the Madura.fr website. For all purchases made in Madura shops or on authorized dealer sites, only the terms and conditions of these shops apply.


The MADURA ONLINE company collects certain information necessary to process orders.

Such data is not only necessary to process the customer’s order; but also to provide the Customer with information about the brand "Madura" on the Website or with "Madura" product offers, if the Customer accepts it while validating his order.

Information is strictly confidential and is listed with an asterisk (*) when necessary to the MADURA ONLINE company, and/or its contractors as part of the management of the customer order.

Following any injunction or legal authorities to defend the rights or those of its employees, customers or anyone else, the MADURA ONLINE company may provide your information to agencies and authorities legally authorized.

The MADURA ONLINE company agrees to take every precaution to ensure the security of its files and protect its computer system, and prevent personal information such as the Customer’s from being distorted, corrupted or available by unauthorized parties.

The Customer’s personal information is sent to and stored by the hosting company located in France, whose coordinates appear on the Website under the heading “Legal”. Under the Data Freedom and Protection Act of January 6, 1978, as amended by the Act of August 6, 2004, the Customer has the right of access, rectification, modification, and deletion of data.

According to the French law " Informatiques et Libertés " n° 78-17, from 6 January 1978, as modified by the French law from 6 August 2004, you have a right of access, rectification, and opposition to your nominative data

The Website is registered with the National Commission for Computing and Liberties –CNL under the number 1351361.

The Customer may exercise this right by sending a letter to the following address or by email, stating your full name, email and mailing address:

The Customer can also change their personal data from its customer service area identified with the help of his email address and password.


To process the Customer’s order, and in order to better understand their needs and customize the services offered on the Website, our Website uses cookies. A cookie is a file stored on the hard drive of the Customer’s computer that is intended to signal his passage on the Website.

The cookies memorize the time of the visit of the Customer on the Website, its identity (known thanks to his email and password) and the contents of his basket. Once disconnected from the Website, this information is stored for thirty (30) days before being permanently deleted.

The Customer may oppose the registration of cookies by configuring their browser. It then loses any customization service that is offered on the Website.


Placing an order on the Website implies knowledge and acceptance of procedures on the Internet in particular with regards to technical performance, response times, connections, queries or information transfers, the risks of disconnection, the risks of contamination by viruses circulating on the network and in general all the risks associated with using the Internet.

The MADURA ONLINE company cannot in any way be held liable for any direct or indirect damage, resulting from misuse or incident relating to the use of the computer, Internet access, maintenance or malfunctioning servers, telephone line, or any other technical connection; the connection of the Customer to the Website is under his full responsibility.


The MADURA ONLINE company is not responsible for non-performance or part of its Obligations under the order placed by the Customer, if such non-performance is caused by an event of force majeure (act of god) as defined by substantive law.

In such a case, the MADURA ONLINE company will inform the Customer of the occurrence of such event within 3 (three) days after its occurrence, by email.

After a period of 1 (one) month, and the assumption the event constituting a force majeure (act of god) persists, the order will be canceled and will, when appropriate, be recoverable on the credit card that was used to place the order within a maximum of 30 (thirty) days.


If any of these terms of the Terms and Conditions is found invalid, illegal or unenforceable by a court other provisions of the Terms and Conditions shall remain in effect.

The Terms and Conditions are performed and interpreted in accordance with French law.

In the case of litigations, the Customer’s priority will be to adress the MADURA ONLINE company in order to reach an amicable agreement. Failing to reach an agreement, the courts of law will be competent.
